Dans un précédent numéro de Médecine & Droit (2008 ; pages 157–159), Racinet et al. ont critiqué les solutions de deux décisions des
juridictions américaines rapportées par nous, vu leur caractère nouveau et du fait qu’à notre connaissance, la question n’a pas encore été traitée
explicitement par les juridictions françaises. Il s’agit de la question relative à la valeur juridique des critères d’imputabilité d’une infirmité motrice
d’origine cérébrale (IMOC) à un manque d’oxygène pendant l’accouchement. Ces critères sont issus d’une publication du Collège américain des
gynécologues-obstétriciens (ACOG) de 2003. On abordera ici la motivation de cette jurisprudence.
